Overview

This Privacy Disclosure Statement & E-mail Communication Consent is relevant to consumer credit arrangements facilitated by National Salary Packaging, a trading name of Shante Pty Ltd (ABN 80 110 261 768, Australian Credit Licence 409538) (we, us, our). Consumer deals covered by this statement include personal loans arranged through NSP's lender panel for personal, household, or domestic purposes - including finance for used cars, caravans, motorbikes, and debt consolidation. This statement explains how we collect, use, store, and disclose your personal and credit information in connection with sourcing and arranging consumer credit on your behalf, in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and the Privacy (Credit Reporting) Code 2024 (CR Code). When you sign the declaration at the end of your personal loan application, you agree that we may collect, use, and exchange your personal and credit information for the purposes described in this statement, consistent with Australia's privacy and credit reporting laws.

Why we collect your information

In connection with a personal loan or consumer credit arrangement, we collect personal and financial information about you to:

  • Assess your suitability for consumer credit and confirm your identity, employment, and income
  • Source suitable consumer credit from our lender panel on your behalf
  • Submit your application to one or more credit providers
  • Source any insurances required in connection with your loan
  • Manage the application process and communicate with you about your application
  • Comply with our legal and regulatory obligations under the National Consumer Credit Protection Act 2009 (Cth) and applicable privacy legislation

If you do not provide the information we request, we may be unable to process your loan application or may be limited in the services we can offer you.

Your information - collection and Credit Reporting Body disclosures

⚠ Credit Check Disclosure

By submitting this application, you consent to a credit enquiry being made with Equifax Australia and/or other credit reporting bodies. Equifax Australia is the most commonly used credit reporting body in Australia and is very likely to be accessed as part of your credit assessment.

When we collect information from you in the credit application process, we use that information to assess your application and to source a suitable credit provider or insurer. We may:

  • Disclose your identification information to a credit reporting body (CRB) and in some cases obtain a credit report about you
  • Use any information the CRB provides in that report to assist us to preliminarily assess your consumer credit application
  • Disclose your personal information to an insurer or insurers to source any insurances you wish to obtain
  • Disclose your credit information to one or more credit providers to apply for finance on your behalf
  • Disclose your personal information to an aggregator to enable submission of your credit application to the credit provider

The information we obtain from you is used only for the purposes listed in this statement and is not disclosed to any other person except with your permission or as permitted or required by law.

Credit providers

We may submit your application to one or more credit providers from our lender panel. A credit provider to whom we submit an application may disclose information about you to, and collect information about you from, one or more CRBs. Credit providers may also engage directly with a CRB to make a credit enquiry. The website of each credit provider contains details of:

  • Each CRB with which it deals and how your credit information is handled
  • Whether your information may be held or disclosed overseas and in which countries
  • How you can obtain the credit provider's privacy policy and CRB policies
  • Your right to access and correct information held about you
  • Your right to complain about conduct that may breach privacy and credit reporting laws
  • Your right to request a CRB not to undertake pre-screening for direct marketing purposes
  • Your right to request a CRB not to release information about you if you believe you are a victim of fraud

Credit providers may provide your personal information - including your driver licence or passport details - to an identity verification organisation to confirm your identity. Electronic identity verification may be used for this purpose. CREDIT REPORTING BODY DISCLOSURE By submitting this application you consent to a credit enquiry being made with one or more of the following credit reporting bodies (CRBs): • Equifax Australia (formerly Veda) - equifax.com.au - the most commonly used CRB in Australia; very likely to be accessed as part of your credit assessment • Experian Australia - experian.com.au • illion Australia - illion.com.au Equifax Australia is used by the majority of Australian lenders and finance providers to conduct credit analysis. When a credit provider assesses your application, they will typically obtain a credit report from Equifax Australia containing your credit history, repayment record, and any defaults or court judgements.

Salary packaging and personal loans

Where you are an existing NSP salary packaging client applying for a personal loan through NSP, please note that:

  • Your loan repayments may be eligible to be salary packaged as part of your everyday living benefit, subject to your employer's approval and applicable FBT caps
  • Information about your salary packaging arrangement - including your employer, your gross salary, and your existing deductions - may be used to assess your loan application and to structure any salary packaging of repayments
  • Your employer will be informed of any salary packaging of loan repayments as this requires a payroll deduction to be established

If you are applying for a personal loan that will not be salary packaged, your salary packaging arrangement details will not be shared with the credit provider without your consent.

Commissions and remuneration

NSP may receive commissions, fees, or other remuneration from credit providers in connection with arranging your personal loan. The specific commission arrangements applicable to your loan will be disclosed in the Credit Guide provided to you before credit assistance is provided, in accordance with our obligations under the National Consumer Credit Protection Act 2009 (Cth). These arrangements do not affect the finance terms or costs you receive and are disclosed in the interests of full transparency.

Overseas disclosure

Some credit providers, insurers, and service providers we engage with may store or process your personal information outside Australia. Where this occurs we take reasonable steps to ensure those overseas recipients protect your information in accordance with Australian privacy laws. Specific details of overseas disclosure by each credit provider are available on their respective websites or in the privacy documentation they provide at the time of approval. Under APP 8, once information is disclosed to an overseas recipient, NSP may not always be able to ensure that recipient's compliance with the Australian Privacy Principles.

Your rights

In connection with your personal loan application, you have the right to:

  • Request access to all personal and credit information NSP holds about you
  • Request correction of any information that is inaccurate, incomplete, or out of date
  • Request copies of this Privacy Disclosure Statement and NSP's Privacy Policy in a form that suits you - including hard copy or email
  • Ask a CRB not to use your information for direct marketing pre-screening purposes
  • Ask a CRB not to release information about you if you believe you are a victim of fraud
  • Withdraw consent to electronic communication, noting that doing so may affect our ability to process your application

Disclosure and consent

By signing your personal loan application you agree we may:

  • Use your personal and credit information to assess your consumer credit application and to source suitable finance and any insurances you require
  • Disclose to, and obtain from, any prospective credit provider or insurer, information about you that is reasonably necessary to obtain the finance and insurances you require
  • Check your information with the document issuer - such as an employer, accountant, or official record holder - for the purpose of confirming your identity and the information you have provided
  • Obtain from, and disclose to, any third party, information about you that is reasonably necessary to assist you to obtain the finance and insurances required
  • Provide your information, including your credit report, to one or more credit providers so they can assess your application
  • Provide you with offers or information about other goods or services we or any of our associated entities may be able to provide, unless you tell us not to
  • Disclose your personal and credit information, to the extent permitted by law, to other organisations that provide us with services - such as contractors, agents, lawyers, document custodians, and computer systems providers - so they can perform those services for us

E-mail communication consent

You consent to receive from NSP, and from any credit provider or other organisation to whom we refer you or submit an application on your behalf, any notices, disclosures, or documents which we or they are required by law to provide to you - including Credit Guides, quotes, credit proposal disclosure documents, and approval documents - via your nominated email address rather than in hard copy. You agree we may email you at your nominated email address with:

  • Notices or information about your loan application or approved arrangement
  • Notices or information about our services
  • Reminders and updates about your application

You should advise us promptly if your nominated email address changes and ensure that your email account remains secure. We will not be responsible for any disclosure of your personal information resulting from your failure to keep your email address secure. We will have complied with any obligation to provide you with a document or notice if we send it to your nominated email address, even if the email is returned unclaimed or is not received by you for any reason. You may withdraw consent to email communication at any time, however doing so may affect our ability to progress your application.

Data breaches

In the event of a data breach involving your information, NSP will notify you as soon as practicable in accordance with our obligations under the Notifiable Data Breaches scheme and the Privacy (Credit Reporting) Code 2024.
